1. Agreement to Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Provider Information

Spirian is operated by the NKCADEV Development Team. Until formal incorporation, the contracting party is the support team of NKCADEV. Contact: support@spirian.ai

3. Eligibility

The Service is intended solely for users who are eighteen (18) years of age or older. By using the Service, you represent and warrant that you are at least 18 years old.

4. Beta and Early Access Notice

You acknowledge that the Service is currently in a Beta / Early Access phase. By using the Service, you understand and agree that:

• Features may change, be removed, or behave inconsistently without notice.
• The Service may experience periods of unavailability.
• While we take reasonable safeguards, data loss may occur. We reserve the right to modify, suspend, or discontinue the Beta access at any time.

6. The Nature of AI Guides

By using the Service, you acknowledge and agree that:

• You are interacting with an Artificial Intelligence, not a human being, clergy member, therapist, or divine entity.
• AI outputs can be factually inaccurate, incomplete, or misleading ("hallucinations"), including on topics regarding theology, history, or scripture.
• You are responsible for evaluating the accuracy of any output and should verify important guidance with qualified human sources.

To maintain a safe environment, you agree not to:

• Use the Service for any illegal activity.
• Generate or request content involving hate speech, harassment, sexual exploitation, or violence.
• Attempt to bypass safety filters or "jailbreak" the system.
• Reverse engineer the Service (including prompt extraction) except where explicitly permitted by law.
• Disrupt the Service through malware, interference, or abuse of APIs.
• Violate the privacy or rights of others.

We reserve the right to suspend or terminate accounts found in violation of these rules.

9. Safety and Privacy Escalation

We value your privacy and do not routinely review private conversations. However, if automated safety systems detect signals indicating a credible, imminent risk of self-harm or harm to others, we may take reasonable steps—including limited human review or account restriction—to ensure safety and comply with legal obligations.

10. Paid Features and Subscriptions

If you purchase subscriptions or "Turn Packs" (interaction credits):

• Pricing: Prices and specific features will be displayed clearly at checkout.
• Consumables: Turn Packs are digital consumables. Once used, they are non-refundable, subject to mandatory local laws.
• Subscriptions: Subscriptions renew automatically until cancelled. Cancellation takes effect at the end of the current billing period unless otherwise stated.

(Note for EU/UK Customers: By clicking "Purchase" or similar buttons at checkout, you request immediate performance of the contract and acknowledge that you may lose your right of withdrawal once the digital content is provided.)

11. Third-Party Services

The Service utilizes third-party providers (e.g., OpenAI API, cloud hosting) to function. We are not responsible for outages, errors, or failures caused by these third-party providers that are beyond our reasonable control.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

You agree to indemnify and hold NKCADEV and its team harmless from any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

15. Termination

You may stop using the Service at any time. We reserve the right to suspend or terminate your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms or if we discontinue the Beta program.

16. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. You agree that any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the competent courts located in Tel Aviv, Israel. You hereby consent to the exclusive jurisdiction and venue of such courts and waive any objection thereto.

17. Changes to Terms

We may update these Terms from time to time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
